1. Acceptance of Terms

By accessing or using the Dalwadi Samaj mobile application (distributed via the Amazon Appstore and direct download from dalwadisamaj.online/download) and website ("Service"), you agree to be bound by these Terms of Service ("Terms"). The App is not available on Google Play Store. If you do not agree to these Terms, please do not use our Service.

The Service is owned and operated by hardikkanajariya.in. These Terms govern your use of the Service and any related services provided by us.

2. Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 18, you should use the Service only with the involvement of a parent or legal guardian.

3. Description of Service

Dalwadi Samaj is a community platform designed to:

• Connect members of the Dalwadi community worldwide
• Provide family tree visualization and genealogy features with relationship calculation
• Enable venue discovery and booking for community events
• Facilitate a social feed with posts, comments, likes, and ephemeral stories
• Provide direct messaging between community members
• Offer a member directory and surname-based search
• Display community news in multiple languages (English, Gujarati, Hindi)
• Provide games, entertainment content, and a virtual rewards system
• Facilitate blood donor matching (opt-in)
• Show agricultural market prices (Mandi Bhav)
• Offer a digital community identity card
• Provide a digital store for badges, frames, and other virtual items

4. User Registration and Accounts

To use certain features of our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your 6-digit PIN and/or OTP credentials secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access
• Not create multiple accounts for the same person

Managed Profiles: You may create profiles for family members who do not have their own accounts. You are responsible for the accuracy of information in profiles you manage. Those individuals may later claim their profiles through OTP verification.

5. User Conduct

You agree not to:

• Use the Service for any illegal purpose
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users through posts, messages, or any other feature
• Impersonate any person or entity
• Create false family tree connections or claim profiles that do not belong to you
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Collect user information without consent
• Post spam or unsolicited communications, including in direct messages
• Exploit bugs, glitches, or vulnerabilities in games to earn coins unfairly
• Use automated tools, bots, or scripts to interact with the Service
• Circumvent ad display mechanisms or manipulate the rewards system

6. Content and Intellectual Property

The Service and its original content, features, and functionality are owned by hardikkanajariya.in and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit but grant us a non-exclusive, worldwide, royalty-free license to use, modify, display, and distribute such content in connection with the Service. For detailed content guidelines, please refer to our User-Generated Content Policy.

7. Direct Messaging

The Service provides direct messaging between community members. By using this feature:

• New conversations require a chat request that the recipient must approve
• You are responsible for the content of messages you send, including text, images, audio, video, and files
• We do not proactively monitor private messages but may review reported content
• Messages are subject to the same content standards as public posts
• Message delivery and read receipts are tracked and visible to participants

8. Venue Booking Terms

When booking venues through our Service:

• We act as an intermediary platform; we are not the venue operators
• Bookings are subject to availability and venue owner approval
• Cancellation policies vary by venue and are displayed at the time of booking
• Payment terms, if any, are specified at the time of booking
• We are not responsible for venue-related disputes, safety, or quality

9. Virtual Currency (Coins) and Digital Store

The Service includes a virtual currency system ("Coins") and digital store:

• Coins are earned through daily logins, watching rewarded ads, playing games, referrals, and other in-app activities
• Coins have no real-world monetary value and cannot be exchanged for cash, refunded, or transferred outside the platform (except gifting to other users within the app)
• Coins can be used to purchase virtual items in the digital store (badges, avatar frames, profile highlights, feature unlocks)
• We reserve the right to modify coin earning rates, prices, available items, and expiration policies at any time
• Abuse of the rewards system (e.g., using automated tools, exploiting bugs) may result in coin forfeiture and account suspension
• Upon account deletion, all accumulated coins are permanently forfeited

10. Games and Leaderboards

The Service includes casual games and community leaderboards:

• Game features are provided for entertainment purposes only
• Game scores and rankings are based on user performance and may be displayed publicly on leaderboards
• Daily game limits and coin earning caps may be enforced
• We reserve the right to reset leaderboards or modify game mechanics at any time

11. Advertisements

The Service displays advertisements powered by Google AdMob. By using the Service, you acknowledge that:

• You may see banner ads, interstitial (full-screen) ads, and optional rewarded video ads
• Google AdMob may use device identifiers and ad interaction data as described in our Privacy Policy
• You may manage ad personalization through your device settings

12. Push Notifications

The Service may send push notifications for community updates, messages, booking confirmations, birthday reminders, and other alerts. You can manage notification preferences within the App's settings or through your device's system settings.

13. Over-the-Air Updates

The App may receive over-the-air (OTA) updates that deliver bug fixes and improvements without requiring an app store update. By using the App, you consent to receiving these automatic updates.

14. Blood Donor Feature

The blood donor matching feature is provided on a strictly voluntary, opt-in basis:

• We are not a medical service and do not verify blood group accuracy or donor eligibility
• We do not guarantee donor availability or response
• All donation decisions are between the donor and recipient; we bear no responsibility for outcomes
• You may opt out at any time by disabling the feature in your profile

15. Limitation of Liability

To the maximum extent permitted by law, hardikkanajariya.in shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to: loss of data, loss of virtual coins or rewards, inaccurate family tree information, venue booking disputes, or health outcomes related to the blood donor feature.

16. Account Termination

We reserve the right to terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may request deletion of your account at any time through the App (Profile → Privacy & Data) or via our web-based deletion form. Account deletion is subject to a 30-day grace period during which you may cancel the request. Upon completion, all associated data is permanently deleted, except for an audit record retained for legal compliance.

17. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. See our Disclaimer for full details.

18. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes through the Service, via push notification, or by updating the "Last updated" date. Continued use after changes constitutes acceptance of the modified Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and its amendments. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gujarat, India.
